Agreement
These terms are an agreement between you and WhiteBoston LLC (dba Pitch Planner) (“we”, “us”) for the Touches iPhone app and this website. By using Touches you agree to these terms and to our privacy policy. If you’re under 18, a parent or guardian must agree to these terms for you.
Who can use Touches
- Anyone can use Touches on their iPhone. There are no accounts and no sign-up.
- If you’re under 18, you need a parent or guardian’s agreement to these terms, including to any purchase.
- You’re responsible for use of Touches on your iPhone, including Club activity from it.
Membership and billing
- Touches membership is an auto-renewing subscription, billed monthly or annually through your Apple Account. Prices are shown in the app before you buy.
- Each iPhone can use one free practice session of up to 3 minutes, once. After that, practice needs a membership.
- Eligible new subscribers get a 3-day free trial. If you don’t cancel at least 24 hours before the trial ends, the subscription starts and you’re charged.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel it in your Apple Account subscription settings.
- Apple handles payments and refunds. To request a refund, contact Apple.
- Deleting the app or using Delete all my data doesn’t cancel a subscription.
- If prices change, Apple will notify you as its rules require, and you can cancel before the new price applies.
Practice safely
Soccer practice is physical activity and carries a risk of injury. You’re responsible for choosing a safe space and practicing within your ability.
- Warm up, use suitable shoes for your surface, and stop if you feel pain or dizziness.
- Keep your phone and stand out of the ball’s path, and keep people, pets and breakable things clear.
- Younger players should practice with an adult nearby.
- Practice guides and in-app tips are general information, not medical, fitness or coaching advice.
Counts are estimates
Touches counts with the camera, and counts can miss or misread contacts, especially with fast play, poor light or a ball leaving the frame. Counts, streaks, personal bests and Club scores are estimates, not certified results, and aren’t a measure of a player’s overall ability.
Clubs and community rules
Clubs are for friendly practice challenges. Our team creates each Club and gives its organizer a code to share. Every player appears under an anonymous name, such as “Striker 4821”, assigned by the app. Clubs have no chat, typed names, photos or free text. When you use Clubs you agree not to:
- submit scores you know are false or manipulated, including scores from another person’s practice or from video;
- try to find out who other players are, or use a score or name to bully, threaten or harass anyone;
- share a Club code publicly or with people the Club isn’t meant for;
- file reports you know are false or use reports to harass someone.
You can report a score or block a player from the Club board, or email us. Blocking hides that player’s scores from you. Our team reviews reports and acts within 24 hours, for example by removing a score or removing a player from a Club. We may stop an iPhone from using Clubs if it breaks these rules.
Email support
Support is by email at support@touches.pitch-planner.app. Don’t send passwords, payment card numbers or health information. We handle support emails as described in the privacy policy. Replies are help with the app, not professional advice.
Your content
You keep ownership of what you submit, such as shared scores, reports and support emails. You give us a limited, non-exclusive license to store, process and display it as needed to run Touches, for example to show your shared scores to your Club. You’re responsible for what you submit.
Acceptable use
Don’t misuse Touches. That includes trying to get around membership checks or security, accessing our servers or APIs other than through the app, interfering with the service, reverse engineering the app except where the law allows it, or using Touches for anything unlawful.
Our content and licenses
The Touches app, website, guides, illustrations and brand belong to us or our licensors. We give you a personal, non-transferable license to use the app on Apple devices you own or control, as allowed by the App Store terms. Open-source components, including the RF-DETR ball detector, are used under their own licenses, listed in the app under Settings → Open-source licenses.
Changes and termination
We may change, add or remove features. If we change these terms in a material way, we’ll tell you in the app or on this site before the changes take effect. Continuing to use Touches afterwards means you accept the new terms. You can stop using Touches at any time and use Delete all my data in Settings to remove your data. We may suspend or end access if you break these terms or to protect other users.
Disclaimers and liability
To the extent the law allows, Touches is provided “as is” and “as available”, without warranties of any kind, including warranties of accuracy, fitness for a particular purpose or uninterrupted availability. To the extent the law allows, we aren’t liable for indirect, incidental or consequential damages, or for injuries or property damage that happen during practice, and our total liability for any claim is limited to the amount you paid for Touches in the 12 months before the claim, or $50 if you paid nothing. Some places don’t allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer protection law.
Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Texas, unless the law where you live gives you the right to bring a claim locally.
App Store terms
If you got Touches from Apple’s App Store:
- These terms are between you and us, not Apple. Apple isn’t responsible for Touches or its content.
- Apple has no obligation to provide maintenance or support for Touches.
- If Touches fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation for Touches.
- Apple isn’t responsible for claims about Touches, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims. We are responsible for handling those claims as required by these terms and the law.
- You confirm you aren’t in a country subject to a U.S. government embargo and aren’t on a U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- Apple’s Standard End User License Agreement also applies. If these terms conflict with it, these terms apply where the law allows.
